Striking
overhead objects with the Equipment. |

All loss or
damage associated with vandalism, malicious mischief, theft or conversion of
the Equipment, not documented by Customer's prompt filing with the
applicable police or public authorities (with an immediate copy to Erb) of a
formal written theft, vandalism or conversion report. |

3. |
Boom damage from
overloading of a boom (exceeding rated capacity) or from a collision when a
boom is in motion. |
|
4. |
Use of the
Equipment by a person other than an authorized operator as defined herein. |
|
5. |
Use or
operation of the Equipment in violation of any law or ordinance. |
|
6. |
The failure of Customer
to perform the basic maintenance requred under Paragraph 7 of the Rental
Agreement. |
|
7. |
Damages
incurred in the transportation of the Equipment by the Customer or a hired
trucker retained by the Customer. |
|
8. |
Downtime due
to mechanical breakdown or failure of performance of the Equipment. |
